£22k benefit swindle of tragedy dad

A 54-YEAR-OLD man who lost his fingers in a family tragedy worked as a pizza deliveryman while claiming incapacity benefit, a court heard.

John Jones, of Slowgrove Close, Trowbridge, admitted failing to notify a change in circumstance to obtain benefits at Swindon Crown Court on Friday.

Jones lost all the fingers on his right hand as he tried to rescue his son and brother from a fire, which took their lives in 1992. But 11 years later he started to work, firstly delivering pizza and then for a cleaning company while still claiming benefits.

The former bouncer falsely claimed more than £22,000 over a three and a half year period. John Dyer, prosecuting, said following the loss of his fingers Jones went on to sickness and severe disablement benefits.

Over the years it changed to become incapacity benefit which he was receiving in May 2003 when he started working for Dominoes Pizza in Castle Street, Trowbridge. He continued working there taking home £139 a week until December 2005, four months after he started working for Direct Cleaning Services Ltd, now called Initial.

At the time he was receiving about £60 a month disability allowance and £86 a week incapacity benefit. He was also receiving housing benefit and council tax benefit.

Mr Dyer said between May 2003 and November 2006 he received £16,781.74p incapacity benefit and £5,601.24p housing benefit making a total of £22,382.98p.

Michael Wills, defending, said his client had been working as a bouncer at the Flamingo Club in 1992 when the fire happened. Jones had tried to rescue his five-year-old son and brother but did not succeed, sustaining damage to his hand.

Judge William Hart imposed a 20-week jail term suspended for a year and ordered him to do 150 hours of community service and a basic skills programme.

A confiscation hearing was adjourned until the autumn where Jones could be ordered to repay all of his ill-gotten gains under the Proceeds of Crime Act.

He could have done permitted work for 52weeks and still got incapity benifit you can dla no matter how many hours you work.
I feel really sorry for him, but at the end of the day he cheated and got caught.

Mr Jones did a heroic and brave thing in 1992 and suffered a horrible injury during the process. However, there are many many people suffering after effects of tragedies - am I to assume that 'Disgusted' thinks it is, therefore, acceptable for all these individuals, should they so choose, to flout the law and defraud the country out of money to which they are not entitled? Fraud of this nature is THEFT and the person responsible knows very well that they are , in effect, stealing from other taxpayers, many of whom also work very hard for not much return ( and who possibly have sad pasts too!). I am sure Mr Jones is ashamed of his error and will learn from it. I wish him all the best for the future.

I am not condoning the benefit fraud BUT this man despite being seriously disabled probably mentally as well as physically after what he has been through has done more than most on benefits to try and get his life back together. There could surely have been alternatives to prosecution to help him when it was found out that he was not acting lawfully. A criminal conviction for fraud will hardly help the situation will it?

I look forward to those in a position to help him offering him a job now that he has proven that he is a bloke not afraid of hard w*rk.

come on John Jones could get a job, that why he got caught fidding benifits.
The story srrounding this is tragic.
but at the end of the day you can not go around stealing money from the goverment, because of a tragic incedent from your pass.

Totally wrong. 'Benefit cheats' are ALWAYS caught when they do part time cash in hand w*rk that no one else will do such as pizza delivery work. These are NOT real jobs. Sure Mr Jones should have declared his income but what he has done is a p1ss in the ocean compared to where the real fraud lies i.e at government level. Cases like this are just taking attention away from where the real problem lies.

Do you think for one minute that you would really get a reduction in your income tax if all benefit fraud was stopped? It is laughable to suggest so. The money saved wouldn't end up in your pocket, it would end up in MP's pockets.

I cannot believe people are condoning benefit fraud. The majority have to work hard, pay high taxes and i do not want to be financially supporting thieves.

Beware risk of liable action from Domino Pizza! They are a legitimate large company who doubtless do everything by the book - they dare not risk otherwise...

Its commendable that Mr Jones is not afraid of hard work, just a shame he was simultaneously claiming benefit which supported the idea that he was not CAPABLE of any work!

Why oh why do you persist in referring EVERY news story you see fit to comment on as an excuse to personally insult a certain individual? They are fully welcome to try it on and we'd see if they would say who they use for delivery personel and supply records.

But all you are doing in the end is reducing some poor sods take home bread and butter for their kids not their 2nd home publicly paid for contents of the fridge.

I am neither 'Russell' or 'Heather'.
Interesting, as alway,s that both of you fall by the wayside so quickly and end up rambling about something totally unconnected to the original news item.
To recap for your benefit;
the news item was about benefit fraud, not politicians and the perks they (rightly or wrongly) enjoy.
Incidentally, yes, some people do exert their right to vote at local and general elections. That is how democracy works. We each have the right to demonstrate our opinion by who we vote for. Those who are elected are inevitably not necessarily everybody's choice. Nonetheless, those voted to represent us at local and national level are at least doing something, not just complaining!
Clearly Westbury is blessed with a glut of impassioned people, may I suggest you all use this wonderful intellectual energy you have for positive purposes rather than just complaining about what those in office are achieving - or not? Maybe 'Disgusted' and Sally Beenwell should stand for local election and really make a difference instead of talking about it?

well it doesn't stop him cleaning or delivering pizza (driving). I work in IT which wouldn't be a problem, most office / retail would be ok. Incapacity should mean what it says.

no, that is why we have tax credits etc to top up the pay of workers on low pay. We also have a minimum wage.

You seem to be saying that it's ok to steal if you haven't got much money??

I pay 3-4K a month in personal tax and ni and would like that money spent wisely!

I totally agree with all the comments posted by MrOldTownRed.
I fail to comprehend how or why 'Disgusted' still defends the illegal actions of a man who was clearly capable of paid employment but chose to rob others in the community by fraudulently claiming INCAPACITY benefit. Either this is all too close to home for 'Disgusted', hence his/her empathy...or he/she really is just a whopping great hypocrite as he/she is always first in the queue to launch accusations of people in public office claiming monies to which he/she feels they are not entitled.....even though they LEGALLY are entitled to these monies. Does 'Disgusted' consider him/herself above the law of this land?
I still stand by my earlier comments that Mr Jones will hopefully have learned well from this and that he can now put it behind him and look forward to a happier future. Many people make mistakes and this is one that has not done anyone any actual harm and Mr Jones is to be punished accordingly. British justice at its best

I can hardly pay my mortgage because im paying for benefit cheats. Its time to get real; if you can work you are not entitled - why is it so difficult for some to comprehend that. There are people out there with much greater need but go without, why - because they are honest.

Well, I fully agree with ''Disgusted'' on this one. It seems some of you have no compassion left in your brain washed heads of yours.
This man suffered a horrendous tragedy, he will probably never be the same person again. Does that touch any of you at all? Imagine yourself in his shoes. Many people top themselves for less than that, yet this man, even with a VERY REAL disability has kept going and has the desire to work. At College for my Diploma in Social Care we had to do one Home Ec lesson with one hand tied behind our back. I suggest for all those of you who seem to think working for this man would be easy, that you try this. It is more restrictive than you think. Little tasks can be difficult to manage and time consuming.
It seems some of you have no compassion left in you, Disgusted clearly empathises with others. He does not seem to be condoning this mans actions, but he can see that he is just a human being who made the wrong choice in a very difficult scenario.

And yes I also agree, that there are millions of decent, honest people who go without and who struggle daily, carers of family and friends etc. No one to blame apart from the people running the Country. The rich just get richer and the poor get poorer.

When things swing too far one way, you need to swing to the other extreme just to create the required balance.
