Roadworks stress blamed for attack

A CAFÉ owner in Warminster who attacked a man in the street blamed it on the stress of mounting debts caused by roadworks in the town, a court heard.

Mark Brassington, 49, the owner of Jacqueline's Restaurant and Tea Rooms in High Street, appeared at Chippenham magistrates' court on Tuesday, where he admitted a charge of causing actual bodily harm in October 2007.

The court heard how Brassington, who lives in a flat above his restaurant, attacked Richard Peaty, who was causing a late-night disturbance outside his home.

In his defence, Brassington said he was stressed about the financial impact six-months of roadworks in High Street were having on his business.

A Wiltshire Probation report read out to the court said: "He (Brassington) does have £3,000 in rent arrears which is connected to the roadworks and being in Warminster at the moment.

"Business is very slow at the moment and it is impacting on him and his partner financially."

On the day of the assault, the court heard how the victim, Mr Peaty from Frome, had been embroiled in a row with his wife as they walked along High Street.

Keith Ballinger, prosecuting, said: "They were having an argument and Mr Peaty, in anger, kicked a road sign several times."

'Hearing a disturbance outside of his bed and breakfast business, Brassington called the police and went down to inspect what was going on.

Witness statements described how Mr Peaty had warned-off the restaurateur and taunted him by saying what are you looking at? Come on then.' Referring to a statement from Mr Peaty's wife, Mr Ballinger described how Brassington had grabbed the victim in a headlock and dragged him to the floor and punched him in the face while holding him down with his knee. The victim's wife then screamed at the defendant to get off and hit him repeatedly with her handbag.

Brassington admitted twice punching Mr Peaty while on the floor. Mike Jeary, defending, said: "He got up and did the right thing and went back in and waited for the police. He admits he lost his temper albeit for the short term. It is something he is going to regret for many a day in the future."

Brassington was sentenced to a six-month community order, including a curfew between 8pm and 6am.

Speaking after the court case, Brassington said the roadworks had cost his business more than £20,000.

He said: ""The roadworks went on much too long. We didn't have a car pass us all summer."

its got nothing to do with the roadworks he just couldnt control his temper, be a man and admit it! whenever you read a case in the paper theyve always got a feeble excuse for why they did it.

My God, why should he have to tolerate a scumbag trashing stuff outside where he lives. Perhaps if somone was booting your wheeliebin around late at night you might go out and an incident might occur. Frankly I am glad the bloke got a beating, I hope the punches were solid ones. the fact this guy got a sentence and not a reward is a pity. Drunks cause so much grief the more of them get a beating the better, it might sto a lot of them from being so anti-social in the first place. I'm sure that there are plenty of people who might say he should have ignored it, hell no, we ignore far too much. Good on you Mr Brassington, I hope that you dream sweet dreams of those few punches when ater your community service.

Well Dazman, it is society's constantly turning the other cheek and facing the other way that has led to a climate in which scumbags fear no retribution from either the public or the authorities that has helped engender a feeling of arrogance among our youth and aggression among those who might otherwise refrain in fear of the consequences. My humble and anarchic opinion of course :)

I agree with YetiJoe to a certain extent. Society is on the decline wherever you look. Noone has any respect for anything or anyone these days. I don't know where the blame lies, but its about time the Gov't gave things a shake up. We can't discipline our kids so they run amok, then as they grow older, they carry on and things get worse. While I don't condone the actions of Mr Brassington I can understand where he is coming from. He is not the first and sure as eggs is/are eggs, he won't be the last.

Far too harsh a punishment for doing what many would like to do. If we still had a proper local bench with JPs drawn from the town and meeting in the town hall, then he would have been given a conditional discharge - there was no intent. As someone who has lived in the town for 50 years I can quite honestly say that there are more idiots walking around at night than ever before. Many people will admire what this man did, myself included, even though it was against the law.
My wife and I will be paying a visit to the restaurant on pay day and I would hope other residents of the town will show their support for Mr Brassington by supporting him with their patronage.

Thankfully I am able to criticise our society as freely as this. As to beating the hell out of him, it was ABH not GBH. Had he actually caused the guy serious injury then I would hold a different view. Perhaps my miniscule brain did a little bit of thinking about it? :) Be anti-social outside someone's home late at night and then goad them with a "come on then" what do you expect Daz? Please, please do me a favour and don't stand up for drunk fools like that. He got exactly what he deserved.

some one has to stand up to he drunks who frequent Warminster at a weekend smashing shop windows up rooting flowers in the tubs kicking the wheelie bins over.
and generally making a nuisance of themselves. could never go round town at night with the wife she never felt safe glad I moved to a quieter place
