Former Royal Marine Douglas Collier is stunned to have become the oldest person in Wiltshire to be given an Asbo at the ripe old age of 74.

Cancer sufferer Mr Douglas, who is adored by his 17 grandchildren, could hardly believe it when a police woman turned up on his doorstep in Westbury Leigh and handed him an interim anti-social behaviour order which had been issued by Chippenham Magistrates’ Court on July 27.

Mr Douglas, who was once a proud wearer of the green beret as a member of 40 Commando Royal Marines in national service, was accused by neighbours Stuart Adey and Evelyn Harrison of giving them abuse and smearing dog excrement on their house. But Mr Collier said this week: “I had just been into Westbury to pick up a prescription.

“I didn’t know anything about it until a policewoman from Westbury came out here. She asked to see me and said they were going to take me to court on September 7.

“The order says that I have sworn at them in the garden and that is drivel. This to me is just evil.”

He is supported by neighbours Lesley and David Blaber who say Mr Collier is the model family man.

Mrs Blaber, 63, said: “He’s a good neighbour who always offers help and looks after you.

“He’s a good family man and was a hard-working businessman all his life.

“I think it’s disgusting that he’s been given this Asbo.”

The retired builder lives with wife Beryl, 66, and their granddaughter Leanne Holland and her dog Alfie in Westbury Leigh, Mr Collier's daughter-in-law, Hazel, 43, who lives next door, said: “I think it’s downright disgusting that a chap of his age can be issued with this.

“The authorities never asked him his side of the story. They’ve treated him like a yob.

“We don't need the stress and the trauma.”

Mr Collier worked for Westbury building firm J D Annetts until 1979. He then became a self-employed builder but had to retire after a hip operation in 2002.

He has prostate cancer and also suffers from arthritis, glaucoma and lung problems.

He said: “I’ve been here 48 years and never had any problems. I’ve never done anyone any harm. I would help anybody.

“I’m 75 this year and I’ve never been in court and never been in trouble. This has spoilt my reputation. I’m very proud of my reputation.”

But Inspector Dave Minty of Warminster and Westbury Police said: “The decision to take this action was not taken lightly. We take reports of this nature very seriously and in this case alternative measures did not prove successful.”

Mr Adey and Miss Harrison who made the accusations moved out a month ago.

But under the order, Mr Collier has been prohibited from contacting them or going within two metres of any of their vehicles or encouraging other people to do so.

He is due to appear at Chippenham Magistrates’ Court again on September 7 for a review of the Asbo.

The fact that he was not allowed to give his side of the story before getting the asbo does not seem fair. It was so strange that I wonder if it was a case of mistaken identity, and it was not him that should have got the asbo at all.

Good old Dave Minty. Screwing it up again. He ought to join the crew that were featured in the guardian the other day, smashing in the windows of a pensioners car "because he wasn't wearing a seat belt."

im just wondering how it got to the stage of an asbo if you are to believe this story. you dont go getting an asbo withno reason and for on incident. its a last resort after other ways have not worked... so i think there is more to this story than meets the eye

allegidly most of his kids were all gobby and troublemakers at school!!!

There is definately more to this story than this,come on Minty spill the beans because i know unless there is a fair amount of evidence an asbo is not given.

Older people in poor health that are adored by their grandchildren simply would not behave in such a manner - he would have to be a real sicko neighbour to behave in this way so I suspect all the claims must be invented as everyone knows he cannot possibly be a nutjob - as he seems an adorable decent sort i know he will be looking out to ensure no one smears excrement on his next door neighbours house - after all, his reputation means a lot to him.

We are only being told one side of the story here. Firstly, although Mr Collier's age, illnesses and former military service enhance the WT article they are of course irrelevant to the issue of an ASBO. No ASBO, not even an interim one, is given which is based only on uncorroborated statements from other people. Evidence must always be presented to back up the allegations. And if the allegations are made falsely or with malice then those making the accusations are likely to be prosecuted - for conspiracy to pervert the course of justice in an extreme case. Mr Collier states 'I did not know anything about it' but Inspector Minty states ' ... in this case alternative measures did not prove successful'. So there is clearly some case to answer and I'm sure the full facts will emerge at the hearing on September 7th. And in response to the post from 'frankie007' - the full facts of that case are yet to emerge as well. In fact the 70 y.o. driver was prosecuted for failure to wear a seat belt and illegal window tints on his Range Rover. His windows were smashed in not because of those (minor) offences but because he failed to stop for police despite a chase and the use of a 'stinger'. If you watch TV series like 'Road Wars' on Sky TV you will see that this technique is often used on cars which fail to comply with police instructions and quite right too. This case made the news only because of the age of the driver. When all the facts of that case are made public it will be shown that police were acting properly in the circumstances and no disciplinary action will be taken against them.

As many have said there is definitely more to this story than what has been reported so far and I'm sure it will make fascinating reading.
