A WAITER who attacked police and a bouncer as they tried to remove him from a club has been ordered to carry out unpaid work.

Harry Cotterill launched the assault at The Boston Shaker, in Weymouth Street, Warminster, on November 4 after he refused to leave the dance floor when an altercation broke out between two other clubgoers.

The 20-year-old became angry and threw a glass on the floor before he started to hit out.

On Friday, Salisbury Magistrates’ Court heard that bouncer Angeline Bowser and a colleague tried to get Cotterill up the stairs of the club.

Prosecuting, Kate Prince said Cotterill continued to lash out and hit Ms Bowser’s face causing a swollen lip.

“He then spat in the face of Ms Bowser. She put her hand over his mouth and realised she wasn’t able to wipe the spit from her face straight away.”

Police arrived but Cotterill, of Chestnut Close, Frome, did not calm down and instead punched out at PC Hargreaves.

“As officers were starting to deal with Mr Cotterill, they had handcuffed him and he punched the left side of PC Hargreaves' temple and then punched him a further four or five times,” Ms Prince said.

CCTV of the attack, which caused fellow club-goer Frances Roberts to be pushed to the ground, was shown to magistrates.

“Ms Roberts tried to keep out of the way. She is then pushed to the ground and she is trampled on by the officers as they were trying to get hold of Mr Cotterill,” Ms Prince added.

The court heard that Cotterill had “very little” recollection of what happened when questioned by police.

Defending, Harriett Heard said that the whole assault was as a result of “flailing arms” rather than directed punches.

She added that Cotterill was still ashamed of his behaviour and embarrassed that his parents had to watch what he had done.

“This is something you never want, to be in court with your 20-year-old son. They never had any inkling he would act in this way.

“His friends had never seen him like this. He has drunk before but probably never to this extent. Everybody has been completely shocked about how drink has turned this young man into something completely different,” she said, adding that Cotterill has not drunk alcohol since as he has become frightened by the whole experience.

Cotterill admitted two counts of assault by beating and another of assaulting a constable in the execution of their duty.

Magistrates imposed a 12-month community order, 120 hours of unpaid work and a curfew from 7pm-7am Friday to Sunday.

He was also ordered to pay £50 compensation to each of the victims and £85 court costs.
