Jail for illegal immigrant caught twice by same police officer
An illegal immigrant caught using another man's driving licence when he was stopped twice by the same police officer has been jailed.
Aquino Windeth, 27, had already been thrown out of the after being jailed for six years in 2008 for drugs offences.
Now Windeth, who sneaked back into the UK, will again be deported back to Jamaica when he has served his 18-month sentence.
Tessa Hingston, prosecuting, told Swindon Crown Court on Friday he was only caught using the false ID because the same police officer stopped him twice.
Windeth was first pulled over on the A350 at Bumpers Farm in February when he produced a licence in the name of Winston Lewis.
He was reported in that name, with an address in St Paul's, Bristol, for not having insurance for the BMW he was driving.
But before Mr Lewis could be arrested for not answering a summons Windeth was stopped in Sutton Benger by the same officer. He again produced the licence of the other man, who is a vulnerable person with learning difficulties and mental health problems.
Miss Hingston said as well as using his driving licence Windeth had used Mr Lewis's identity to open bank accounts. She said the Border Agency was taking steps to again deport him.
Windeth, of Easton, Bristol, admitted perverting the course of justice, two counts of possessing an ID document for improper purposes and driving without insurance or a licence.
Mark Lineham, defending, said his client had three children aged seven, six and five with his wife, who is pregnant, in Chippenham.
If he had tried to use his own identity then he would be sent back to the Caribbean which is why he used Mr Lewis's licence.
Judge Douglas Field said: "You had the false documents in my judgement to gain entry and to remain here illegally.
"I confidently expect you to be deported firstly because of your status here and secondly because I have passed a sentence in excess of 12 months."
