A WARMINSTER man has appealed against Wiltshire Council's refusal to let him vary a section 106 agreement which stipulates he must make a £60,897 contribution to affordable housing.
Robin Denton wants to discharge the S106 agreement obligation in respect of his plans to build one house at 4 Tangier Close, Warminster.
He requested the discharge in May but in July Wiltshire Council refused his application.
The development at 4 Tangier Close was approved subject to a Section 106 agreement containing a planning obligation to provide £60,897.60 for a contribution towards affordable housing elsewhere in the district.
Because Mr Denton has failed to provide the contribution, the council has refused planning permission for the development.
The council said: “As a matter of principle, the local planning authority has had no alternative other than to refuse.”
Anyone wishing to comment should send them to the Planning Inspectorate in Bristol by December 17.
