A COUPLE in Kingsdown near Corsham have won their appeal against Wiltshire Council's refusal to allow them to build a Juliette balcony.

Mr and Mrs Jon Maddicott wanted to build the balcony to a first floor of extension under construction at their home in High Street, Kingsdown.

But Wiltshire Council refused permission and the couple appealed the decision.

Planning Inspector R E Jones visited the site on March 16 and saw that building work was already at an advanced stage.

He has concluded that the balcony will not impinge on the privacy of neighbours at nearby Woodland Manor.

The inspector said: "The main issue is the effect that removing condition number four would have on the living conditions of occupiers of Woodland Manor, with particular reference to their privacy."

He varied the planning permission by deleting condition four and imposed another condition. The couple's claim for costs is subject to a separate decision.
